Terms of Service
1. Agreement and nature of the Service
These Terms of Service (these "Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the operator of Domestic Monero ("Operator," "we," "us," or "our") governing access to and use of the Domestic Monero peer-to-peer digital asset trading platform, including the Telegram Mini App interface, notifications, documentation, and ancillary services (collectively, the "Service"). By accessing, registering for, initiating, accepting, or completing any transaction through the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. The Service provides technology-enabled peer-to-peer matching, trade orchestration, status monitoring, payment verification assistance, notification delivery, and settlement coordination. The Service is an administrative and technological facilitation layer; it is not a guaranteed execution venue, central limit order book exchange, broker-dealer, investment adviser, commodity trading adviser, fiduciary, trustee, deposit-taking institution, or insured financial institution. No communication, rate display, fee hint, notification, or interface content constitutes investment, legal, tax, accounting, or financial advice. The Operator does not guarantee that any offer will be matched, that any counterparty will deposit stake, submit payment proof, or act within deadlines, or that any trade will complete successfully. You alone are responsible for evaluating offers, counterparties, and trades.
2. Multisig Trade Wallet, Trade Pendency Period, and 2-of-3 multisig settlement
Where a trade requires seller stake, the seller must transfer the specified Monero (XMR) amount to the Multisig Trade Wallet address displayed for that trade. During the Trade Pendency Period (commencing upon seller deposit and ending upon Disbursement, Restitution, or final resolution of the trade), staked XMR remains subject to 2-of-3 multisig for state-gated, deterministic settlement in accordance with these Terms and in-app trade rules. No single party, including the Operator, can unilaterally move staked XMR. Domestic Monero implements 2-of-3 multisig pursuant to which Disbursement or Restitution of staked XMR requires (i) satisfaction of the applicable trade state and verification requirements, and (ii) submission of valid Authorization Credentials by the requesting trade party, followed by coordinated settlement processing by the Service — publicly described as a 2-of-3 authorization threshold. Upon trade creation, each trade party receives distinct Authorization Credentials associated with that trade, commonly presented in the interface as a "trade share." Each trade party is solely responsible for securely storing its Authorization Credentials; loss, compromise, or failure to retain Authorization Credentials may prevent Disbursement or Restitution notwithstanding satisfaction of other trade conditions. Digital Assets are not legal tender, are not bank deposits, and are not insured by any deposit insurance scheme. You bear all risk of loss associated with Digital Asset transfers, network conditions, and trade outcomes.
3. Operator role, settlement coordination, and compliance cooperation
The Operator provides matching, timers, payment verification, and coordinated settlement processing. The Operator does not complete a buyer Disbursement or seller Restitution unless the trade is in the correct state and the requesting party submits valid Authorization Credentials. The Operator does not guarantee counterparty performance and is not a party to off-platform payment obligations between users. Disputes between trade parties regarding off-platform payment, delivery of fiat or Digital Assets outside the Service flow, or alleged misrepresentation are primarily between counterparties. In-app states, timestamps, submitted proofs, and blockchain records constitute primary evidence of Service-side trade progression. The Operator maintains risk-based procedures designed to detect and mitigate illicit use, including automated and manual review, sanctions screening where implemented, velocity monitoring, and transaction holds. The Operator may request additional information, documentation, or verification where reasonably necessary for compliance or risk management. The Operator maintains procedures to respond to lawful demands, subpoenas, court orders, warrants, and regulatory inquiries from competent authorities, and may preserve and disclose account identifiers, trade metadata, blockchain transaction data, timestamps, and communications reasonably necessary to comply with applicable law. Where legally required or reasonably necessary for compliance, the Operator may delay, block, or restrict processing or access pending review. Except where required by applicable law, the Operator is not obligated to notify you of reporting or disclosure to authorities.
4. User representations, warranties, and obligations
You represent, warrant, and covenant that: (a) you are at least eighteen (18) years of age (or the age of majority in your jurisdiction) and have legal capacity to enter these Terms; (b) you are not located in, organized in, or a resident of any jurisdiction where use of the Service is prohibited; (c) you will comply with all applicable law, including tax reporting obligations arising from your trades; (d) you will not use the Service for fraud, market manipulation, sanctions evasion, money laundering, terrorist financing, or any unlawful purpose; (e) all offer terms, addresses, and payment instructions you provide are accurate; (f) you understand counterparty risk and the irreversible nature of Digital Asset transfers; and (g) you are not relying on the Operator as advisor, guarantor, or insurer of counterparty performance. You are responsible for accurate offer rates, payout and payment addresses, optional OpenPGP public keys, and completing required actions before displayed deadlines. Incorrect addresses or missed deadlines may result in cancellation, timeout, or loss of funds. Where configured, OpenPGP enables encrypted delivery of sensitive trade materials; failure to configure OpenPGP does not relieve you of Authorization Credential storage obligations.
5. Trade lifecycle, timeouts, and automated resolution
Trades progress through defined states with time limits for stake deposit, payment proof submission, verification, and authorization actions as displayed in the Service. Cancellation rights, if any, depend on trade state and in-app controls. Failure to perform required actions within displayed deadlines may result in cancellation, timeout, Restitution, Disbursement, or other outcomes prescribed by the trade rules without further notice. You acknowledge that automated state transitions are integral to the Service architecture and agree that outcomes produced thereby shall be binding subject to applicable law. Blockchain transactions are irreversible once confirmed; processing times may vary based on network conditions.
6. Prohibited conduct and enforcement
Without limitation, you shall not: (a) use the Service in violation of sanctions administered by the United Nations, United States OFAC, European Union, United Kingdom, or other competent authorities; (b) attempt to circumvent geolocation, rate limits, authorization controls, or security measures; (c) provide false payment proofs, forged transaction hashes, or misleading trade information; (d) scrape, reverse engineer, or interfere with Service infrastructure except as permitted by law; (e) use the Service on behalf of third parties without authorization where such use is restricted; or (f) operate mixers, tumblers, or anonymization services through the Service in violation of applicable law. The Operator may suspend, restrict, cancel trades, or terminate access immediately for suspected violations, risk, or legal requirement.
7. Disclaimers, limitation of liability, and indemnification
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE OPERATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. THE OPERATOR DOES NOT WARRANT UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, SECURITY FREE FROM INTRUSION, ACCURACY OF MARKET DATA, OR THAT DEFECTS WILL BE CORRECTED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, DIGITAL ASSETS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. TO THE EXTENT LIABILITY IS NOT EXCLUDED, THE OPERATOR'S AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) FEES PAID BY YOU TO THE OPERATOR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (US$100). You agree to defend, indemnify, and hold harmless the Operator and its directors, officers, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your trades or offers, your violation of these Terms or applicable law, or your dispute with a counterparty. Neither party shall be liable for failure or delay due to events beyond reasonable control, including network congestion, blockchain forks, daemon outages, Telegram platform disruptions, acts of government, war, natural disasters, or third-party infrastructure failures.
8. Modifications, suspension, termination, and contact
We may modify these Terms at any time by posting updated Terms in the Service. Continued use after the effective date constitutes acceptance. We may modify, suspend, or discontinue features with or without notice where reasonably necessary for security, compliance, or operational reasons. We may terminate or suspend access immediately for violation, risk, or legal requirement. Provisions intended to survive shall survive termination. These Terms constitute the entire agreement regarding the Service. If any provision is invalid, it shall be modified minimally to be enforceable; the remainder continues in effect. Failure to enforce any provision is not a waiver. You may not assign these Terms without consent; we may assign in connection with reorganization or sale.
